Late, Belated and Revised ITR Filing

Late, Belated and Revised ITR Filing

A belated return under section 139(4) lets you file after the due date, generally until 31 December of the assessment year, with a late fee under section 234F and interest under 234A. A revised return under 139(5) corrects mistakes. SVT & Associates prepares both and an updated return under 139(8A) where needed.

Return types

Which return can I file after the due date?

The type depends on the year and on whether you had filed. A belated return under 139(4) is for people who missed the due date, and a revised return under 139(5) is for people who filed and found a mistake. Both generally close on 31 December of the assessment year. After that, an updated return under section 139(8A) can be filed within an extended period, on payment of additional tax on top of the tax and interest due, and it cannot be used to claim a refund or reduce tax. The additional tax starts at 25% and increases the longer you wait.

Cost of delay

What does filing late actually cost?

Besides the late fee of ₹5,000 (₹1,000 if total income is up to ₹5 lakh), interest at 1% a month applies on the unpaid tax from the due date, and interest under 234B and 234C if advance tax was short. The bigger cost is often the loss of carry-forward of capital and business losses, and a delayed refund. House property loss can still be carried forward. We compute the total cost for you before you decide, and tell you if a condonation request makes sense for a refund claim.

FAQ

Frequently asked questions

Can I still file my return after 31 December?
For most years, the belated and revised return window ends on 31 December of the assessment year. After that, you can file an updated return under section 139(8A) within the extended period on payment of additional tax, subject to conditions, for example it cannot be used to claim a refund. We tell you which options remain.
Will I get a refund if I file late?
A refund is still possible with a belated return filed within the allowed time. The refund may be delayed because the interest on refund starts only from the date of filing for late returns. For old years where the time has run out, a request for condonation of delay under section 119(2)(b) can be made.
What is the penalty for not filing at all?
There is a late fee under 234F, interest under 234A, and the department can issue a notice under section 142(1) or start proceedings. In some cases, prosecution under section 276CC can follow for wilful default where tax is large. Filing early with an explanation is better than waiting for a notice.
How do I fix a mistake in a return already filed?
A revised return under 139(5) replaces the earlier one, provided it is filed within the time limit. Mistakes include missed income, wrong bank account and wrongly claimed deductions. A new return can be filed multiple times until the deadline.
Is a return valid if I did not e-verify?
No. An unverified return is treated as not filed, and the department can issue a notice. E-verification is required within 30 days of filing; after that, a condonation request can be made. We always confirm that verification is complete.
I received a notice for not filing; can I just file now?
Yes, within the time stated in the notice and generally before the assessment is completed. Filing in response to a notice under section 142(1) or 148 follows specific procedure. We read the notice first to see which section it falls under, and respond accordingly; see section 148 reply.
What is the last date to file an income tax return?
For individuals and HUFs who do not need an audit, the usual due date is 31 July after the financial year ends. Cases needing a tax audit normally get 31 October, and companies with transfer pricing reports 30 November. The government sometimes extends dates, so we confirm the notified date for your year before we start.
What happens if I miss the ITR due date?
You can still file a belated return under section 139(4), generally until 31 December of the assessment year, but with a late fee under section 234F (₹5,000, or ₹1,000 if total income is up to ₹5 lakh) and interest under 234A. Most losses cannot be carried forward in a belated return, which can cost more than the fee itself.
Do I need to e-verify my return after filing?
Yes. A return is treated as filed only after e-verification, which must be completed within 30 days of filing. You can verify with Aadhaar OTP, net banking, a pre-validated bank account or a demat account. We guide you through it and confirm the processed status on the portal afterwards.
