Presumptive scheme

Is section 44ADA better than keeping books for a professional?

Section 44ADA lets specified professionals, such as doctors, lawyers, engineers, architects, accountants and interior designers, treat 50% of gross receipts as profit. The limit is ₹50 lakh of gross receipts, or ₹75 lakh when cash receipts are 5% or less. You do not need to keep detailed books. It suits professionals whose real expenses are under half the receipts.

It does not suit everyone. If you have large rent, salaries or interest, or you made a loss, actual books can give lower tax. Content creators and influencers are usually taxed as business or profession; whether 44ADA or 44AD applies depends on the nature of work, which we decide after reviewing your income streams.

Foreign clients

How are foreign clients and export of services treated?

Services supplied to a client outside India and paid for in foreign currency can qualify as export of services, which is zero-rated for GST if the conditions are met. A Letter of Undertaking (LUT) lets you export without paying GST first. The income is taxable in India in full, and any tax withheld abroad can be claimed as credit using Form 67. We also check that the foreign receipt is backed by a FIRC or bank advice so a question from the bank or the department can be answered.

FAQ

Frequently asked questions

Do freelancers need GST registration?
Service providers must register once aggregate turnover crosses ₹20 lakh in a year (₹10 lakh in some special-category states). Exporters of services can register voluntarily and claim input credit. Registration is also needed earlier if you supply through an e-commerce operator. We check your turnover trend and tell you when registration becomes due.
Is TDS cut on freelancer payments?
Yes. Clients usually deduct 10% under section 194J on professional or technical fees above ₹50,000 a year, and 1% or 2% under 194C for contract work. Foreign clients do not deduct Indian TDS. We match every certificate to Form 26AS so you claim the full credit in the return.
Can I show expenses if I am under 44ADA?
No. The 50% deemed profit already assumes your expenses, so you cannot deduct rent, software or travel separately. Depreciation is also deemed allowed. Only deductions under Chapter VI-A, such as 80C and 80D in the old regime, remain available. If expenses are high, choose actual books.
What if my receipts are partly in cash?
Cash receipts matter for the higher 44ADA limit of ₹75 lakh, which needs cash receipts of 5% or less. Cash payments above ₹10,000 a day to one person are disallowed if you keep books. We note the cash share when deciding the scheme and the limit that applies.
How do I report income from YouTube, Instagram or app stores?
Platform payouts are professional or business income, even when paid by a foreign company. Brand collaborations and gifts above ₹50,000 may also be taxable. We classify each stream, report foreign receipts with their dates and rates, and claim any foreign tax credit.
Can I switch between 44ADA and actual books?
You can choose each year, but opting out of the presumptive scheme after having used it can lock you into an audit for the following five years if profit is below the deemed rate. We model both options for the current year and the next before you commit.
What is the last date to file an income tax return?
For individuals and HUFs who do not need an audit, the usual due date is 31 July after the financial year ends. Cases needing a tax audit normally get 31 October, and companies with transfer pricing reports 30 November. The government sometimes extends dates, so we confirm the notified date for your year before we start.
What happens if I miss the ITR due date?
You can still file a belated return under section 139(4), generally until 31 December of the assessment year, but with a late fee under section 234F (₹5,000, or ₹1,000 if total income is up to ₹5 lakh) and interest under 234A. Most losses cannot be carried forward in a belated return, which can cost more than the fee itself.
Do I need to e-verify my return after filing?
Yes. A return is treated as filed only after e-verification, which must be completed within 30 days of filing. You can verify with Aadhaar OTP, net banking, a pre-validated bank account or a demat account. We guide you through it and confirm the processed status on the portal afterwards.
