what is it

What is Professional Tax?

A state-level tax under Article 276 of the Constitution, capped at ₹2,500 a year per person. Registering under the wrong category, PTEC instead of PTRC or the reverse, is the most common mistake we see.

self-employed

PTEC Registration

For professionals, proprietors, partners and directors who pay professional tax on their own income. One-time registration, then an annual payment.

employers

PTRC Registration

For any business with even one salaried employee in a PT state. Requires deducting PT from salary every month and filing periodic returns.

How Professional Tax Applies to an LLP

An LLP's limited-liability status protects partners from the firm's debts — it does not extend to professional tax, which is a separate, personal obligation on anyone earning income from a profession, trade or employment. Where an LLP has salaried staff, it needs a PTRC registration in the LLP's own name. Separately, designated partners who draw remuneration or professional fees from the LLP — rather than a fixed salary through payroll — typically carry their own individual PTEC liability. We see this gap most often in professional-services LLPs (CA firms, law firms, consultancies structured as LLPs), where the partners' own drawings are treated informally as 'partner income' and never separately registered for PTEC, even though the LLP's staff are correctly covered under PTRC. We check both layers for your LLP and register whichever is missing.

Does Your LLP Need PTRC, PTEC, or Both?

Staff on payroll trigger PTRC for the LLP. Partner drawings often trigger separate PTEC. We'll confirm both, free of cost.

questions

Frequently Asked Questions

Does an LLP's limited-liability status cover professional tax too? +
No. Limited liability protects partners from the LLP's debts, not from personal professional tax. The LLP needs PTRC for any staff on payroll, and designated partners drawing remuneration separately often need their own PTEC.
What's the difference between PTEC and PTRC? +
PTEC is for individuals paying tax on their own income, self-employed professionals, proprietors, partners and directors. PTRC is for employers who deduct PT from employee salaries. A company with staff often needs both.
What happens if I miss the registration deadline? +
Most states require registration within 30 days of becoming liable. Late registration typically attracts a small per-day penalty plus interest on any unpaid tax, and it compounds the longer it's left.
Can professional tax be deducted from my income tax? +
Yes. Salaried employees can claim it under Section 16(iii), but only under the old tax regime. Self-employed professionals can claim it as a business expense under Section 37(1).
Do I need PT registration if I only have one employee? +
Yes. The requirement is triggered by having a salaried employee in a PT state, not by headcount. Even one employee triggers PTRC for the employer.
